Prohibited Sections Regulations

1H2O3, is not a market place whose suppliers, manufacturers and craftsmen are selected and presented by a moderator. However, for various reasons, we do prohibit certain types of items on 1H2O3. Some present legal risks to our community while others are incompatible with our values, are detrimental to our members, or simply not in the spirit of 1H2O3. This regulation explains what is prohibited or restricted on 1H2O3

This policy is part of our Terms of Use. By opening a 1H2O3 store, you signify your acceptance of this policy and our Terms of Use.

The following types of items are prohibited or restricted on 1H2O3, which we collectively refer to in this by-law as “1H2O3”.

Political decisions are complex. We consider many different and often divergent factors before reaching a decision on what is best for our community. Because we are an environmentally sensitive community, we can be wrong about the interpretation of freedom of expression. We also tend to allow articles that have educational value, but we know that even these articles are subject to a variety of emotional responses and valid and sometimes contradictory interpretations.

There are some issues on which we can never reach consensus as a community; that’s the way it is. To help provide more clarity and insight in our regulatory development process, we have included the rationale behind our decisions and details on how they will be applied, including some representative examples below of what is permitted on site 1H2O3.

1. Alcohol, tobacco, drugs, equipment for drug use and medicines

Alcohol and drugs are prohibited on 1H2O3. These substances face serious legal restrictions and, in many cases, are considered controlled substances under the applicable law. Our regulations also apply to other substances that have or are supposed to have an intoxicating or curative effect. Apart from possible legal restrictions, these substances are simply not in the spirit of 1H2O3 and therefore we do not allow them.

Here are examples of items that cannot be sold on 1H2O3:

  1. Alcohol
  2. Tobacco products, smoking products, e-cigarettes and e-liquids.
  3. Drugs and certain herbal substances, including substances used for recreational and medicinal purposes, irrespective of their legality.
  4. Drug attractant, including for example, articles with carburetor, bangs and water pipes, and vaporizers and their components.
  5. Medicines and pharmaceuticals.

Restrictions on the description of expected therapeutic effects:

A therapeutic claim is any element of a product information sheet or shop suggesting that an item is preventing, curing or treating a medical condition or disease. Therapeutic claims are subject to varying degrees of legislation. If you are using claims about the expected therapeutic effects of an item on sale on 1H2O3, we strongly recommend that you consult with a qualified expert in the field to determine which regulations apply to you. You are responsible for knowing and complying with all laws and regulations that apply to the items you sell.

Consistent with our values, 1H2O3 prohibits certain therapeutic claims such as claims that may mislead or pose an undue risk to our community. 1H2O3 may remove claims that we consider to be inappropriate or unsuitable for our sales platform. If we receive proper notice from a judicial authority, we may delete an article.

2. Animal products and human remains

Some animal products are highly regulated and, because of the risk of harm to live, endangered or companion animals, are not in the spirit of 1H2O3.

The following are examples of products of animal origin that cannot be sold on 1H2O3:

  1. Live animals.
  2. Articles deriving from or created on the basis of animal species designated as threatened or endangered on endangered species or listed in Appendix I of the CITES Treaty(Convention on International Trade in Endangered Species (CITES).
  3. Products based on skins or parts of cats or dogs.
  4. Ivory or bones of ivory-producing animals, including ivory tusks, elk ivory, fossilized ivory and woolly mammoth ivory.
  5. Articles based on human remains, except hair.

We hope that all our members follow their local laws. When sending articles abroad, we also recommend that you consult the CITES (Convention on International Trade in Endangered Species of Wild Fauna and Flora) treaty for specific information on the import and export of articles that may be threatened by the nature of this trade.

3. Hazardous Items: Hazardous Materials, Recalled Items and Weapons

For security reasons and because of complex legal requirements surrounding certain elements, we ask our members not to sell items that could be considered dangerous.

Hazardous substances

Because of the potential harm caused by hazardous materials, as well as the complex legal provisions surrounding these materials, including transportation restrictions, hazardous materials are prohibited on 1H2O3.

Although the list is not exhaustive, the following items are examples of prohibited hazardous materials:

  1. Explosives (fireworks or magic candles)
  2. Flammable articles
  3. Gas
  4. Radioactive materials
  5. Toxic substances (such as poisons)

Armes

Context is important when it comes to defining what is or is not a weapon. In case of doubt, it is safe to assume that we will not allow any tool or instrument that is intended to be used as a weapon to inflict injury on a person. As a general rule, the following articles are not allowed on 1H2O3:

  1. Rifles, knives or other blatant weapons (same vintage type)
  2. Dummy weapons that look like real weapons

4. Articles calling for hatred: Articles that promote, support or glorify hatred

We want 1H2O3 to be a community in which people of all origins, nationalities, religions, political affiliations, and even with different types of humour feel welcome.

1H2O3 does not authorize articles or product sheets that promote, condone or glorify hatred of persons or belittle people based on the following criteria: race, ethnicity, country of origin, religion, sex, gender identity, disability or sexual orientation (collectively,”protected groups”) or content or articles that promote organizations or individuals expressing such views.

The following items are not allowed on 1H2O3 :

  1. Items that support or commemorate current or historical hate groups, including collection or propaganda items.
  2. Articles that contain racial insults or pejorative terms, referring to protected groups.

5. Illegal articles, articles promoting illegal activities and highly regulated articles

We respect the law and we expect 1H2O3 vendors to respect the law as well.

Illegal items and items that promote illegal activities, including counterfeit or stolen items, are generally not permitted on 1H2O3. Similarly, articles that are subject to complex registration systems or legal regulations are not permitted. To the extent that 1H2O3 is an international company, it is important to respect the laws of the markets in which you offer items for sale. What is legal in one country may be prohibited in another. All forms of illegal activities are strictly prohibited. Furthermore, the product sheets cannot facilitate or promote illegal acts through images or descriptions.

In addition, because of complex legal restrictions that vary by location, 1H2O3 does not allow the sale of real estate or motor vehicles (e. g. cars, motorcycles, boats, travel trailers, etc.).

We ask vendors to follow all applicable laws for the items they sell.

6. Internationally regulated articles

Our marketplace provides a direct connection between buyers and sellers worldwide. If you buy or sell an item from another country, or enter an international transaction, you are responsible for compliance with international trade restrictions.

Members of 1H2O3 should be aware that each country may have its own set of trade restrictions, and that some items may not be permitted for export or import under foreign laws. It is advisable to consult the laws of any foreign jurisdiction when considering a transaction involving the shipment of goods abroad.

Finally, 1H2O3 members should be aware that third-party payment processors, such as PayPal, can independently monitor compliance with transactions and block certain transactions under their own compliance programs. 1H2O3 has no power or control over the independent decision-making of these suppliers.

7. Pornography and Adult Content

As an environmentally sensitive community, we tend to be quite open about what we allow on 1H2O3, but we don’t accept pornography. Beyond that, we prohibit adult content so that people who are offended by this type of material do not have to see it. If you sell adult content, we ask you to understand that different sensitivities exist around the world and that we try to be respectful.

8. Violent Articles: Articles that promote, support or glorify violence

We want 1H2O3 to be a safe place for everyone. No content should ever be used to promote or glorify violence against others.
