Privacy Policy

At 1H2O3, we take the issue of confidentiality very seriously. We believe in transparency and are committed to not concealing from you any of our privacy practices, including how we treat your personal information. We know that you too take the issue of privacy seriously and we provide you with parameters that allow you to choose how certain information is used by 1H2O3. This policy explains our privacy practices for 1H2O3.com and (we will refer to 1H2O3.com as the “Site”), the 1H2O3 mobile applications (the “Applications”) and the services provided by 1H2O3 (collectively,”1H2O3″).

This regulation is part of our Terms of use. By accessing the Site or using the Applications, you consent to our collection, transfer, handling, storage, disclosure and use of your personal information as described in this Privacy Policy. This includes any information you choose to provide that is considered confidential under applicable law. This policy applies only to the Site, Applications and services of 1H2O3. We are not responsible for the content or privacy practices of our members, websites hosted by the Site, third-party websites or applications. Conditions of use 1H2O3’s Terms of Use require that all account holders be at least 18 years of age (or have permission and are supervised by a responsible parent or legal guardian), therefore, this policy does not address the use of our Site, Applications, or services by minors.

Data export

By using 1H2O3, you authorize the company to use your information in Switzerland and in any other country in which 1H2O3 operates. Please be aware that in some countries, privacy laws and standards, including the rights of authorities to access your personal information, may differ from those applicable in the country where you reside. We will only transfer personal data to these countries if permitted by law, and we will take steps to ensure that your personal information continues to benefit from appropriate safeguards.

Information collected or received

To use our platform, you will need to provide us with a valid email address and be able to choose a username. Depending on the services you choose, we may collect additional information, such as information from private communication channels such as Conversations, billing or payment information, a phone number and physical address. Please note that for safety and performance reasons, some 1H2O3 personnel may access this information from time to time.

Your username is publicly displayed and connected to your activity on the Site and Applications. Other people may see your registration date; notes, notices and photos of items you have purchased or sold; your profile information; items you have placed on sale; the pages and terms and conditions of sale of your shop; your favorites, subscribers and subscriptions; product sheets for items sold and the number of items sold; and comments you post on our community areas. You may, on an optional basis, choose to provide and publicly display your full name and other personal information (such as your birthday, gender, and city of residence).

You may connect to the Site or the Applications using an external application, in which case 1H2O3 may receive information from that other service, as explained below.

We use technology, including cookies, invisible gifs, log files, and flash cookies for many purposes, including helping us understand how you interact with our site and services, to provide a better experience.

Uses and Sharing

We use the information we collect from our users in many ways. For example, if you purchase an item, we will share your shipping information with the seller; we may use suggestions you post on forums to improve our services; we use data analysis techniques and work with certain third party service providers to target our online and offline marketing; and of course, we use your email address to communicate with you. We also partner with service providers and other third parties that collect, use and analyze information about 1H2O3’s members and visitors.

1H2O3 will not sell or disclose your personal information to third parties without your consent, except as provided in our Privacy Policy.

Choice

You can view and edit your information in your account settings, and you can delete certain optional information.

You can control the receipt of certain types of communications from 1H2O3 in your account settings. You can also limit certain follow-ups by disabling cookies in your browser.

Information

We will notify you of any changes to our Privacy Policy as described below.


Information collected or received

As a member of 1H2O3, you are required to provide a valid email address at the time of registration and you will then be able to choose a username or pseudonym representing your identity on the Site and Applications.

Depending on the services you choose to use, 1H2O3 may request additional information from you to provide you with such information, such as a shop name, billing and payment information (including billing address, phone number, credit card information), telephone number, and/or physical mailing address. As a 1H2O3 vendor, if you choose to use our payment service, 1H2O3 may require information such as your social security number, personal or tax ID, date of birth, bank account information, credit card information and/or other identification to verify your identity and provide you with this service while complying with applicable legislation. We may store credit card information and use it for both billing and payment purposes. 1H2O3 may contact certain store owners to request, under the seal of confidentiality, more information about their stores or items offered for sale on the Site, or to ensure compliance with our rules and legislation. For some products or services on 1H2O3, it is necessary to submit an application; the information you submit through the application processes will not be publicly viewable and will only be used internally by 1H2O3, unless otherwise specified.

You may, if you wish, choose to provide and publicly display your full name and other personal information (such as your birthday, gender, and city of residence) in connection with your account and activity. If you do not want this additional information to be visible to the public, you can remove it by going to your 1H2O3 Public Profile page.

Your user name, username or nickname is publicly displayed and connected to your activity on the Site and Applications. Other people may see your registration date, notices, notes, profile information, articles for sale, pages of your shop, product sheets of articles sold, and your comments on community spaces.

1H2O3 automatically receives and stores information from your browser or mobile device when you visit the Site or use the Applications, such as your IP address or the unique identifier of your device, as well as cookies and data about the pages you visit on the Site or the Applications, and stores it in log files. We may combine this automatically collected information with other information we collect about you. This information helps us prevent fraud and maintain the security of the Site and Applications, analyze and understand how the Site and Applications work for members and visitors, and provide a more personalized experience for members and visitors.

When using Applications, you can choose to share your geolocation details with 1H2O3 to use our location-based services. If you have notified us of your geographic location but no longer wish to share this information, you can disable these services via the settings on the Applications or on your mobile device. We will only share information about your geographic location with third parties (such as our mapping provider) for the purpose of providing these services to you. You can also enable Applications to access the camera on your mobile device to upload photos to 1H2O3.

Some members or visitors may log in to the Site or Applications, or create a 1H2O3 account using an external third-party application, such as Facebook, or an application developed using the 1H2O3 Application Programming Interface (API). 1H2O3 can receive data from these connected third-party applications. Connecting your 1H2O3 account to third-party applications or services is optional, and when you connect your account to an external application, 1H2O3 will grant you permission to receive information from third-party applications. You can also choose to share some of your 1H2O3 activities on certain social networks connected to your 1H2O3 account. You can change your settings and revoke your authorization from your account settings.

It is possible that 1H2O3 may receive or obtain information (e. g., an email address or IP address) from a person who is not yet a member of 1H2O3 (a “non-member”) in connection with certain features of the Site or the Applications, for example when a non-member subscribes to a 1H2O3 newsletter, or when a member invites a non-member to visit the Site, or when a member downloads information from a non-member via the contact download feature., or a member name initiates a transaction, or a member sends the gift card code to a member name. Non-member information is used only for the purposes described when submitting to 1H2O3. A non-member may contact the support team if they do not wish 1H2O3 to retain their information.

1H2O3 also collects certain information from both members and non-members who visit websites hosted by the Site. This information may include your IP address or the unique identifier of your device, as well as cookies and data from the pages you visit.

Choice and control

We know that members of our community value the control of their own information, and therefore, 1H2O3 gives you the choice to provide, modify or delete certain information, as well as the choice of how we may contact you.

You may modify or correct your account information (except your username) on the Site. You may also remove certain optional information from the Site that you no longer wish to see publicly displayed on the Site.

For various reasons, 1H2O3 may send you messages about our services or your activity. Some of these messages are mandatory because they relate to services for members (such as transaction-related or legal messages). Other messages are not required (such as newsletters), and you can choose the optional messages you want to receive by changing your settings in your account.

If you have chosen to connect your account to an external third-party application, such as Facebook, or an application developed using the 1H2O3 API, you can change your settings and remove the application’s authorization by changing your account settings.

If you no longer wish to use the Site, the Applications or other services of 1H2O3, or receive messages relating to the services, you may close your account.

Traceability

You can connect directly to your email service provider, mobile device address book, or a social network account to import your contacts on 1H2O3. We do not store login information about your email service, mobile device, or social networks that you use. You can search for people you know by email address or phone number on the Site or by connecting to your mobile device’s contact list through the Applications. Finding your friends on 1H2O3 helps you connect with them on our platform. For example, you can subscribe to another member’s public activity, such as Public Favourites. When you start to follow the activity of another member, he or she will receive an email notification (unless that member has deactivated the reception of this type of email).

If you do not want your contacts to be able to find you on 1H2O3 through your email address, phone number or social network connections, then you can disable this feature through your account settings on the Site. If you do not wish to be found on 1H2O3 via your full name, you may remove your name from the public information of your account on the Site. It is not possible to disable the function to find you via your username.

Messages from 1H2O3

1H2O3 will contact you on certain occasions. These messages are essentially transmitted by email or through instant notifications, and each account must be associated with a valid email address to receive messages. 1H2O3 may contact you by telephone to assist you as a member or in connection with transactions if you give us permission to call you. In addition, 1H2O3 may send you an SMS message or mail to provide you with customer support or information about products and features that may be of interest to you. You can update your contact preferences in your account settings.

Some 1H2O3 messages are related to services and are mandatory for members. Examples of messages related to the services include: an email address confirmation, a welcome email when registering your account, an order notification, and communications with the 1H2O3 support team. You cannot disable the receipt of messages from 1H2O3 related to the services unless you close your account.

1H2O3 may also send you messages relating to certain features or your activity on the Site or Applications. 1H2O3 may send you news or updates regarding changes to our Site, Applications, or services. From time to time, we may develop new types of messages and share them with you to give you information about our services. Members will essentially receive these messages via email or instant notification via Applications, but you can choose to disable the receipt of different types of messages via settings on your account or mobile device.

1H2O3 offers optional electronic newsletters. When you create an account, or choose to subscribe to a newsletter, you will receive newsletters from us. Newsletters are made available to both members and non-members. Members can subscribe or unsubscribe from optional newsletters in the account settings or by following the instructions contained in the newsletter emails. Non-members can subscribe by providing an email address, which will be used by 1H2O3 only for these newsletters. Non-members may unsubscribe from a newsletter by following the instructions in the newsletter emails.

A contact import feature is available to help you locate and connect with your friends and contacts who may be 1H2O3 members (see Article Tracking). If someone from your contact list is not yet a member, you can invite them to register on 1H2O3, in which case an email will be sent to them on your behalf. Email invitation recipients can disable the receipt of future invitations by following the instructions in the email invitation message. You can only send an invitation to someone if they have given their consent to receive it.

Community

1H2O3 is both a sales and community platform. We offer several features that allow members to connect and communicate within public or semi-public spaces, such as Forums and Teams. We ask that you exercise common sense and judgment when posting messages on these community spaces or sharing your personal information with others on the Site and Applications. Keep in mind that any personal information you submit may be read, collected, or used by others, or may be used to send you unsolicited messages. Generally speaking, 1H2O3 does not delete content published on community spaces, and your messages can remain public after your account is closed. You are responsible for the personal information you choose to publish on community spaces via the Site and Applications.

Another 1H2O3 member may subscribe to your public activity on the Site to receive updates, for example to be notified when you add an article to your Public Favourites. You may choose to make certain activities private via your account settings on the Site. If a member has started tracking your activity, you have the option to block that member through the Site if you do not want to share your updates with the person concerned.

Use, sharing and disclosure of information

We respect your privacy. 1H2O3 will not disclose your name, email address or other personal information to third parties without your consent, except as provided in this policy. In general, we use information to provide and improve our services and products, for billing and payments, for identification and authentication, for targeted online and offline marketing, to contact members or interested parties, and for general research and reporting.

1H2O3 limits its employees’ access to your personal information. Only those persons who we believe that they reasonably need this information to provide you with products or services or to carry out their activities may have access to this information.

Your information is controlled by 1H2O3 or with other 1H2O3 affiliates for the purposes described in this Privacy Policy, including verification of identifiers, transaction reviews and payment processing. Regardless of the country in which you reside or from which the information originates, you authorize 1H2O3 to use your information in Switzerland and in any other country in which 1H2O3 operates. Please keep in mind that privacy laws and standards in some jurisdictions may differ from those applicable in the country where you reside.

As part of the purchase and sale process, 1H2O3 will facilitate the sharing of information between the two members involved in the transaction, such as the email address, shipping address, and payment information of the other member. By making a sale or purchase on the Site or through Applications, you ask us to share your information in this way. We expect you to respect the confidentiality of the member whose information you have received. As explained in the 1H2O3 Terms of Use, you have a limited license to use this information only in connection with communications related to 1H2O3 or transactions facilitated by 1H2O3. 1H2O3 has not licensed you to use the information in connection with unsolicited commercial messages or unauthorized transactions. Without the express consent of that person, you must not add any member of 1H2O3 to your electronic or physical mailing list or misuse any member’s personal information. Remember that you must comply with all applicable legal rules when using the Site or the Applications. This includes the applicable data protection and privacy laws governing how you may use the information of another 1H2O3 member.

1H2O3 may disclose your personal information to a third party in limited circumstances. We may transmit information to protect, establish, or exercise our legal rights or defend ourselves against legal action. We may disclose information pursuant to subpoenas, court orders, court proceedings, or other legal requirements. We may also disclose information when we believe, in good faith, that such disclosure is necessary to comply with the law, prevent imminent personal injury or financial loss, or in connection with illegal activities, suspected fraud, threats to our property, or violations of Terms of Use.

Please refer to our Request for Information Regulations for more information on how 1H2O3 responds to requests for information or inquiries about members of the 1H2O3 community. In accordance with our Intellectual Property Policy, we may also disclose personal information to parties in connection with investigations of fraud, intellectual property violations, piracy or other illegal activities. In such cases, 1H2O3 may disclose a name, address, country, telephone number, email address and company name.

1H2O3 is affiliated with many companies with which it works closely. These companies may offer promotions (including email promotions) or sell items or services to you through 1H2O3’s services. 1H2O3 may also provide services or sell products jointly with affiliated companies. . When an affiliate is involved in your transaction, we may share transaction information with the affiliate for the purpose of facilitating your transaction.

1H2O3 may share demographic information with business partners, but such information will always be aggregated and anonymous so as not to reveal personally identifiable information.

1H2O3 may engage third party companies and persons (e. g. payment processing companies, consulting firms, analysis and security providers) to assist us in providing our services. These third parties have limited access to your information for the sole purpose of performing these tasks on our behalf and are required, vis-à-vis 1H2O3, not to disclose or use your information for any other purpose.

In some cases, 1H2O3 may choose to buy or sell assets. In these types of transactions (such as a sale, merger, liquidation, receivership or transfer of all or substantially all of the assets of 1H2O3, member information is generally part of the assets of the transferred business. If 1H2O3 intends to transfer information about you, 1H2O3 will notify you by email or by posting a visible notice on the Site and the Application, and you will be given the opportunity to opt out before information about you is subject to a different privacy policy.

Third party plug-ins may also collect information about your use of the Site. For example, when you load a page on the Site that has a social plug-in from a third party site or service, such as a “Like” or “Send” button, you also load content from that third party site. This site may request cookies directly from your browser. These interactions are subject to the rules concerning the confidentiality of the third party site. In addition, certain cookies and other tracking mechanisms on our site are used by third parties for targeted online marketing and other purposes. These technologies allow a partner company to recognize your computer or mobile device each time you visit the Site or use the Applications, but do not allow access to personal information stored on 1H2O3. 1H2O3 cannot access or control these third party technologies and they are not covered by our Privacy Policy. If you prefer to prevent third parties from setting up and accessing cookies on your computer, you can set your browser to block cookies.

We can only speak on our behalf; these rules do not apply to third party practices that 1H2O3 does not own or control, or to individuals not employed or managed by 1H2O3. If you provide your information to others, different practices may apply to the use or disclosure of the information you provide to them. 1H2O3 does not control the privacy policies of third parties or other members of 1H2O3. 1H2O3 is not responsible for the privacy or security practices of 1H2O3 members or other websites, including those that point to or link to the Site or the Applications. We encourage you to ask questions before disclosing your personal information to others.

Security

We value the security of your personal information. Your 1H2O3 account information is password protected. It is important that you protect yourself against unauthorized access to your account and information by carefully selecting your password, and by keeping your password and computer secure, such as logging out after using our services.

1H2O3 encrypts sensitive information (such as credit card numbers) using SSL (Secure Socket Layer) technology. Generally speaking, 1H2O3 follows industry standards in practice to protect personal information submitted to us, both during transmission and after receipt by 1H2O3. Unfortunately, no method of transmission over the Internet or electronic storage is 100% secure. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security. 1H2O3 offers optional advanced security settings for members, such as two-step validation during login, SSL for the entire site, and logon history; you can activate these options in your account settings.

Retention of data

1H2O3 will keep your information only as long as necessary for the purposes set out in this policy, as long as your account is active, or as necessary to provide you with the services. If you no longer want 1H2O3 to use your information to provide you with the services, you can close your account. 1H2O3 will retain and use your information to the extent necessary to comply with legal obligations, resolve disputes, and enforce our commitments. Note that closing your account does not necessarily release your email address, username or the name of your shop to allow you to reuse them on a new account.

You may notify us of any changes or requests regarding your personal data, and in accordance with our obligations under applicable data protection law, we may update or delete your personal data accordingly. We will respond to your request within a reasonable time.

Your rights

If you are a member of 1H2O3, you can access, correct, edit and delete certain personal information associated with your account in your account settings. If you need additional help, you can contact 1H2O3 via one of the communication channels indicated under “Contact”.

Amendments to the Privacy Policy

We may update this policy from time to time. If we believe that changes are material, please be assured that we will notify you by taking one (or more) of the following actions: 1) posting the changes to the Site and Applications, 2) sending you an email or message regarding the changes, or 3) posting an update in the Release Notes on the Application Platform. In this way, you can decide whether you wish to continue using the Site or the Applications. The changes will take effect at the time of publication. You are responsible for reviewing and reviewing any changes. Your use of the Site or the Application following the changes constitutes your acceptance of the updated regulations.
