Electronic Communications Regulations

1H2O3 is required to provide you with certain information in writing. This Electronic Communications Policy describes how we will provide you with this information.

This policy is part of our Terms of Use. By using any of the 1H2O3 services, you agree to abide by this policy and our Terms of Use.

1. The information that will be sent to you by 1H2O3

1H2O3 may sometimes need to send you important messages regarding your use of the 1H2O3 website, mobile applications or other services (collectively, our “Services”). This policy covers all such messages, including the terms, conditions, regulations and user agreements applicable to your use of the Services, billing statements, transaction information, privacy information, tax returns and other legal documents that will be provided to you electronically (collectively,”Electronic Communications”).

2. Communications that will be sent to you electronically

In accordance with these rules, you consent to 1H2O3 in connection with the provision of Electronic Communications (including all legal requirements and information required by law) by electronic means. You also agree that your agreement to the Electronic Terms and Conditions and Electronic Information shall have the same legal effect as signing a written agreement. For example, if you click a button on the 1H2O3 website electronically, and the message displayed next to the button informs you that you have accepted certain conditions by clicking the button, then your click on the button will have the same legal effect as signing a written agreement.

3. Provision of information

1H2O3 may provide the Electronic Communications to you by (a) emailing them to the e-mail address on your 1H2O3 account, (b) publishing them on the 1H2O3 website or mobile applications, or (c) making them available to you through a website designated in an electronic notice addressed to you.

4. Technical Requirements for Receiving Electronic Communications

In order to receive Electronic Communications, you must have the following in your possession:

  • A computer or mobile device;
  • An Internet connection;
  • An Internet browser supporting 128-bit encryption, with cookies enabled;
  • An active email address; and
  • Sufficient electronic storage space on your computer’s hard drive or other data storage device and/or printer installed to print the information.

5. Withdrawal of Consent for Electronic Communications

You may withdraw your consent to receive Electronic Communications at any time by submitting a request to us:

Please note that if you withdraw your consent to receive Electronic Communications, such withdrawal will only be effective after 1H2O3 has had a reasonable period of time to process your withdrawal (usually 3 months). In addition, if you withdraw your consent to receive Electronic Communications, and 1H2O3 is required to send you paper copies of communications, 1H2O3 may cancel your access to the Services.

In order for 1H2O3 to send you paper copies, you must have an active mailing address on your 1H2O3 account. 1H2O3 reserves the right to charge you a reasonable fee to cover the cost of sending paper copies of Electronic Communications to you.

6. Updating your contact information

In order to receive Electronic Communications, you must ensure that the contact information on your 1H2O3 account is accurate. 1H2O3 is not responsible for your non-receipt of Electronic Communications if you do not update your contact information.

We are happy to provide this policy in the language of your choice, but it is important to understand that the French version of this document controls and governs your use of 1H2O3 services. You can change your language preference in your account settings.
